Terms of service

These terms apply to Fovely, the browser extension and the service behind it, provided by Akcan-IT, Muhammed Akcan, Berliner Allee 8, 64295 Darmstadt, Germany ("we"). By signing in you agree to them.
1. The service
During a focus session you start, Fovely checks the titles of videos and web pages against your goal and hides or pauses the ones that don't fit. Its judgements come from an AI model and can be wrong in both directions; you can allow anything it hides. Fovely is a focus aid, not a parental control or security tool.
2. Your account
You need a Google account to sign in. Keep your account to yourself and use Fovely only for yourself. You can delete your account at any time in Fovely's settings.
3. Free and Pro
The free plan includes a daily number of checks, currently 300. Pro adds the features described on our website, including unlimited checks for normal personal use; we may limit use that looks automated or abusive.
4. Buying Pro
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's buyer terms apply to your purchase.
Pro is a subscription, billed monthly or yearly in advance, and renews automatically until you cancel. You can cancel any time under Manage subscription in Fovely's settings; Pro then stays active until the end of the period you've paid for. Refunds are described in our refund policy. If a renewal payment fails, Paddle will retry it for a while and Pro stays on meanwhile; if it keeps failing, the subscription ends.
We may change prices for future billing periods; we'll tell you in advance, and you can cancel before the change applies.
5. Fair use
Don't try to break, overload or get around the service or its limits, reverse-engineer the server, or use it to build a competing service.
6. Availability and changes
We work to keep Fovely available but can't promise it's always on. If a check can't be done, Fovely shows the content rather than hiding it. We may improve or change features; if we remove a paid feature in a way that matters to you, you can cancel and ask for a refund for the unused time.
7. Liability
We're liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we're liable only for breaches of essential contractual obligations, limited to the damage typical and foreseeable for this kind of contract. Otherwise our liability is excluded.
8. Ending
You can stop using Fovely and delete your account at any time. We may suspend or close accounts that seriously break these terms; if you have paid for Pro, we'll refund the unused time unless the closure is due to your breach.
9. Law
German law applies, excluding the UN Convention on the International Sale of Goods. If you're a consumer, this doesn't take away the protection of the mandatory law of the country you live in.
